General Terms and Conditions (GTC)
These are the General Terms and Conditions of Bajor Istvan (PetElixir), Wagramer Straße 2A / 123, 1220 Vienna, Austria. This English translation is provided for convenience; the German version is legally binding.
1. Scope and definitions
1.1. These GTC apply to all business relationships between PetElixir (hereinafter the "Seller") and its customers. Customers may be both consumers (B2C) and businesses (B2B).
1.2. Deviating or supplementary terms of the customer are not recognised unless the Seller expressly agrees to their validity in writing.
2. Product characteristics, storage and shelf life
2.1. The Seller distributes specialised liposomal vitamin blends for pets. These products are characterised by a natural composition without artificial preservatives.
2.2. Storage obligation: Due to the sensitive formulation, the products must be stored refrigerated at a temperature of 2 °C to 8 °C. An interruption of the cold chain can lead to spoilage.
2.3. Shelf life: Unopened, the products keep for at least 12 months from production; the best-before date stated on the packaging is decisive. The prerequisite is continuous storage at 2–8 °C. After opening, the products must be used within 8 weeks and must continue to be kept refrigerated. The products must not be frozen.
3. Conclusion of contract
3.1. The presentation of goods in the online shop does not constitute a legally binding offer, but an invitation to order.
3.2. By clicking the button [Order with obligation to pay], the customer submits a binding offer. The contract is only concluded upon dispatch of an order confirmation by e-mail or upon delivery of the goods.
4. Prices and payment processing
4.1. All prices are in euros (EUR). Shipping costs are shown separately.
4.2. The available payment methods are prepayment (bank transfer) and credit and debit card payment via our payment service provider Stripe. With prepayment, the invoice amount must be paid within 5 working days.
5. Delivery and shipping conditions (GLS)
5.1. Shipping is carried out via GLS Austria. The delivery time is normally 2–5 working days, unless stated otherwise.
5.2. Transfer of risk for B2B: For businesses, the risk of accidental loss and accidental deterioration of the goods passes to the buyer as soon as we have handed the item over to the carrier (GLS).
5.3. Transfer of risk for B2C: For consumers, the risk only passes upon delivery of the goods to the customer.
6. Right of withdrawal and its exclusion
6.1. Consumers have a statutory 14-day right of withdrawal.
6.2. Exclusion: Pursuant to § 18 (1) no. 3 of the Austrian Distance Selling Act (FAGG), the right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery. You may return unopened goods that have been properly kept refrigerated within the 14-day period.
6.3. The costs of the return shipment are borne by the buyer in every case.
7. Warranty and limitation of liability
7.1. The statutory warranty rules apply, unless otherwise agreed in section 8 (B2B).
7.2. The Seller is not liable for damage caused by improper storage (non-compliance with 2–8 °C) or overdosing. Our products are complementary feed and do not replace veterinary treatment.
8. Special provisions for businesses (B2B)
8.1. Obligation of immediate notification of defects: Defects must be notified in writing within 3 working days of receipt of the goods, with photos attached. Later complaints are not recognised.
8.2. Complaints regarding quality are only accepted if the business can prove an uninterrupted cold chain (2–8 °C).
9. Copyright and intellectual property
All content on the website (texts, graphics, logos, product names) is the intellectual property of PetElixir. Use without express permission is prohibited.
10. Availability of the website
The Seller strives for constant availability of the website (World4You hosting), but assumes no liability for technical outages or maintenance work.
11. Complaints and dispute resolution
Please first address complaints directly to petelixir@petelixir.at. We strive for a swift and amicable solution. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. The former Online Dispute Resolution platform of the European Union was discontinued on 20 July 2025.
12. Choice of law and place of jurisdiction
Austrian law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for businesses and for consumers without residence in the EU is Vienna.
13. Vouchers, discount codes and promotions
13.1 Scope. These provisions apply to discount and promotional vouchers issued free of charge (hereinafter "voucher codes") granted in the course of promotions, newsletter sign-ups, prize draws or referrals. These provisions do not apply to value vouchers purchased for payment.
13.2 Issue and personal reference. Voucher codes are issued on a personal basis and are not transferable. There is no entitlement to the issue of a voucher code.
13.3 Redemption. Each voucher code can be redeemed once. Only one voucher code can be redeemed per order. Combining several voucher codes or combining them with other promotions is excluded. The code must be entered in the designated field in the cart before completing the order; subsequent crediting to already completed orders is not possible.
13.4 Validity period and minimum order value. The validity period and any minimum order value are announced when the respective voucher code is issued. After the validity period expires, the code loses its effect; no extension or exchange takes place.
13.5 No cash payment. Voucher codes are not paid out in cash and do not bear interest. If the value of the voucher code exceeds the order value, the difference lapses; no residual credit is issued.
13.6 Excluded items. Shipping costs are excluded from the discount unless stated otherwise at issue.
13.7 Withdrawal. If the consumer withdraws from the contract, only the amount actually paid is refunded. The voucher code used is not revived and is not replaced. This provision applies exclusively to voucher codes granted free of charge and does not affect the statutory right of withdrawal under the FAGG.
13.8 Partial return. If only part of an order is returned and the remaining order value thereby falls below the minimum order value of the voucher code, the discount is reduced proportionately. The refund is made accordingly.
13.9 Misuse. In the event of justified suspicion of improper use, in particular passing on, multiple registrations, automated generation or trading of voucher codes, we are entitled to block the code and not grant the discount.
13.10 Changes to and termination of promotions. Promotions can be changed or ended at any time with effect for the future. Voucher codes already issued and still valid remain unaffected.
14. Severability clause
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
